Eisenberg, Cutt, Kendell & Olson Pursues Justice After Bryce Canyon Bus Crash
When our clients embarked on a 7-day tour from Los Angeles to Salt Lake City, they did not expect to have their lives permanently altered. Unfortunately, a tragic bus crash claimed 4 lives and left 26 other passengers wounded. Those who lost loved ones also suffered injuries during the accident. Now, these individuals are facing severe non-economic losses and overwhelming financial consequences.
How We Are Helping
While our firm cannot change the horrific accident our clients experienced, we can help them secure their futures by holding the responsible parties accountable. That’s why we’ve filed a wrongful death lawsuit on their behalf in the Los Angeles County Superior Court.
What Went Wrong
On Friday, Sept. 20, an American Shengja tour bus was heading into Bryce Canyon when it began to veer off the road for an unknown reason. The driver allegedly overcorrected, causing the bus to tip over.
During the rollover, 11 passengers were completely ejected and 2 were partially ejected. Four passengers were killed, 15 suffered serious injuries, and 11 were transported to surrounding hospitals with less severe ailments.
Our complaint alleges that the bus driver failed to exercise reasonable care and permitted their vehicle to overturn. Under the doctrine of respondeat superior, American Shengjia, Inc. is responsible for the negligent conduct of its driver.
The company allegedly breached its duty of care to our clients by:
- Failing to act reasonably in the hiring, training, and supervision of the bus operators at America Shengjia, Inc.
- Failing to ensure that the bus was fit for transporting passengers
- Failing to properly inspect, maintain, service or repair the vehicle
- Changing the design of the bus in a way that made it unsafe
- Violating FMCSA requirements
- Failing to enforce policies and procedures to preserve passenger safety
We believe these wrongful acts and omissions caused the injuries, harms, and losses suffered by our clients.
Why We’re Requesting Compensation
The financial and emotional realities of losing a loved one and recovering from injuries are enormous. The heirs of the decedents suffered economic damages, including:
- Loss of financial support
- Loss of inheritance
- Loss of gifts and benefits
- Funeral and burial expenses
- Loss of household services
Those who were injured in the accident also face medical expenses, lost past and future income and earnings, and other losses.
In addition to these financial consequences, our clients face the loss of their loved ones’ love, companionship, comfort, care, assistance, protection, affection, society, moral support, training, guidance, and intimate relations.
Those injured may also struggle with pain and suffering, and loss of enjoyment of life as a result of their ailment.
Should our case be successful, our clients will be awarded for all of these losses. While they will still have a long road to recovery, they will never be without the resources they need, nor peace of mind.
